National Environmental Quality Act Overview

Closely related to CEQA practice, the National Environmental Policy Act (NEPA) is the essential overarching concept in regards to planning and land use law. This session will provide an overview of the fundamentals of NEPA including:

• NEPA’s legal and regulatory framework;
• Determination of when NEPA applies to federal activities;
• Use of Categorical Exclusions;
• The relationship between findings of no significant impacts (FONSIs) and environmental assessments (EAs);
• When an EIS is required;
• Current standards of judicial review and coordination with CEQA.
