David Hill Development LLC v. City of Forest Grove: A Cautionary Tale

In September 2011, a jury ordered the City of Forest grove to pay a developer $6.5 million in damages resulting from the City's delay in issuing a final plat for a subdivision. The jury and subsequent court order found violations of the Equal Protection Clause, the Due Process Clause, or the Takings Clause of the U.S. Constitution. This may be the largest jury award issued in a land use case and is currently pending review by the 9th Circuit court of Appeals. As such, the facts that gave rise to this controversy as well as the court's decision deserve greater consideration. We will be providing a summary of this case and facilitating a discussion about lessons planners may use to avoid a similar fate.
