2013 Planning Staff And Officials Training Seminar

This training is intended for planning directors, planners, and appointed and elected planning officials, and covers current planning and growth management laws and practices in Florida. It is intended to provide a substantive educational training for planning professionals and the officials responsible for decision making on planning matters.

Part 1: Planning and Growth Management In Florida: (1.5 Hours)
This session will explain the principles of effective planning in the context of Florida’s Community Planning Act, including the practices of land use planning under Florida law; the roles of the planning director, planning staff, as well as appointed and elected planning officials. This session will expand on effective techniques for engaging the public in the planning process.

Part 2: Comprehensive Planning Under Florida’s Community Planning Act (1.5 Hours)
Planning in Florida has changed significantly, under the comprehensive 2011 legislative amendments to Florida’s long-standing growth management statutes. This session will examine the legal status, procedures for amendment and evaluation of the local comprehensive plan, with a focus on current issues and challenges such as school concurrency planning, transportation planning and water supply planning.

Part 3: Land Development Codes and the Implementation of Florida Growth Management (1 Hour)
This session will provide a detailed primer on the most current techniques in land development codes preparation and amendment, including zoning, planning development, concurrency planning, as well as Florida local government experiences with advanced implementation tools and techniques including urban design standards, traditional neighborhood and New Urbanist development standards, form-based codes and “smart growth” codes.

Part 4: Planning Law 101: (1.5 Hours/Law Credits)
This session will provide a detailed overview of important legal concepts and up-to-date legal analysis of case law affecting Florida planning. This session will be led by expert land use attorney and certified planner Susan L. Trevarthen, Esq., AICP. Participants will learn the important legal distinctions between legislative and quasi-judicial decisions, and how preparation and conduct of a public hearing is essential to ensure the legal defensibility of the decision on a development application. Ms. Trevarthen will also provide an overview of critical case law updates on First Amendment planning law (sign law, adult use law and religious land uses). Additionally, this session will offer important guidance on how to ensure that planning legislation and decisions are legally sufficient in an increasingly litigious legal environment.

Part 5: Planning Ethics: (1 Hour/ Ethics Credits)
This session will address the critical ethical requirements for planners, planning officials and elected officials. This session will highlight the key requirements of Florida’s Government in the Sunshine Law, the Florida Code of Ethics and the AICP Code of Ethics. Mr. Boles will identify the key pitfalls to avoid during the planning process, and how to ensure that ethical considerations remain at the forefront of the planning and decision making process.
