Overview

This session will provide historical context regarding regulatory takings and exactions.  Further, the session will discuss recent U.S. Supreme Court decisions that impact land use planning and local government decisions.  Finally, some best practices and lessons learned will be discussed.   Attendees will understand how zoning and subdivision regulations/decisions can lead to regulatory takings and exaction concerns.; understand how the new regulatory takings test announced by the U.S. Supreme Court in Murr v. Wisconsin impacts land use regulation; and understand how the U.S. Supreme Court’s 2013 decision in Koontz v. St. Johns River Water Management District affects the efficiency and effectiveness of land use regulation.
