Marijuana-Related Uses

The town’s code permits medical marijuana businesses and retail marijuana establishments, subject to licensing standards (§14-4-1 et seq.). Its licensing standards address zoning district use permissions; separation from childcare facilities, schools, and halfway houses; proximity to residences; home delivery; home occupations; colocation; hours of operation; signage; marijuana accessories; display of marijuana; taxes; and duties of primary caregivers.

The code includes use-specific standards for home cultivation (§9-13-1 et seq.). Its standards address compliance with state laws, age restrictions, number of plants, sales, enclosure requirements and visibility, security, permissible locations, noticeability of operations, odor, compliance with building and technical codes, property owner consent, chemical enhancements or extracts, and compressed gas.

Solar Energy

The town’s code encourages sensitive placement of panels and lists preferences for solar panel location in conservation districts. Class C Minor development permit is required (§9-1-19-5A.E.1, E.2).

Outside conservation districts, solar devices are encouraged. Class D development permit required; regulations cover preferred panel locations, color, angle of installation (§9-1-19-5A.3).

Subdivision site plans must be designed to promote energy efficiency, including solar access within the development (§9-2-4-1.E).
