Group Housing

The city's land development code defines and regulates two types of community residences: family community residences and transitional community residences. The distinguishing characteristic between these uses is length of stay and not the number of residents (§11.2.5). Both uses are subject to separation requirements and occupancy limits, but operators can apply for a disability accommodation (§2.4.17).

Content-Neutral Sign Regulation

The city’s land development code includes sign regulations amended in response to the U.S. Supreme Court’s decision in Reed v. Town of Gilbert (Land Development Code §6.12). These regulations maintain distinctions between on- and off-premises signs and commercial and noncommercial speech, under the assumption that these distinctions will either not trigger the “strict scrutiny” test for content-based regulations or that they will satisfy this test because the distinctions are “narrowly tailored to serve a compelling governmental interest.” 

The list of exempt signs also includes some seemingly content-based categories: traffic signs, directional signs, street addresses, safety signs, and governmental flags (Land Development Code §6.12.3). However, the Reed decision singled out these types of signs (with the exception of governmental flags) as the types most likely to survive strict scrutiny.

Meanwhile, the city’s public ways and property code prohibits all private signs on public property (§8-6).
