Transfer of Development Rights
Kentucky’s planning and zoning enabling statute authorizes local governments to establish transfer of development rights programs (§100.208). It addresses the voluntary nature of development rights transfers, development after transfers on sending sites, receiving site density, deed restrictions and easements for sending sites, displaying sending and receiving areas on the zoning map, and transfers between jurisdictions.
