Planning and Zoning Enabling Laws
Idaho requires all counties and cities to prepare comprehensive plans. And it authorizes all counties and cities to adopt zoning regulations.

Transfer of Development Rights
Idaho’s planning and zoning enabling statute authorizes cities and counties to establish transfer of development rights programs (§67-6515A). It requires a market analysis prior to establishing sending and receiving area, specifies the voluntary nature of the program, requires consistency with the comprehensive plan, indicates that procedures for the issuance and recording of the instruments necessary for severance and transfer must be documented, and prohibits a city or county from conditioning an application to suit a desired zoning change if the applicant is otherwise entitled to application approval.
