Planning and Zoning Enabling Laws

Transfer of Development Rights
Tennessee’s zoning enabling statute authorizes counties and municipalities to establish transfer of development rights programs (§13-7-101(a)(2) & §13-7-201(a)(2)). It designates the appropriate legal filings for establishing a program, explains the purpose and terms of sending and receiving sites, and allows for a municipal transfer of development rights bank.
