Content-Neutral Sign Regulation

The town’s sign code includes provisions amended in response to the U.S. Supreme Court’s decision in Reed v. Town of Gilbert (§13.09). It generally adheres to a literal interpretation of content neutrality (i.e., you do not have to read a sign to know whether it is in compliance with the regulations). However, the list of exempt signs does include signs erected by governments, decorative lighting displays that do not display a commercial message, and traffic control devices(§13.09.020(d)). It includes a clear message substitution clause (§13.09.020(g)(4)) and a clear severability clause (§13.09.020(h)).
