Marijuana-Related Uses

This article uses the example of local prohibitions on medical marijuana dispensaries in California to discuss the limits of local zoning authority. It cites a number of basic zoning case law precedents and argues for avoiding prohibitions of uses legal under state law, absent explicit authorization to prohibit those uses.
