Marijuana-Related Uses

The city’s business licensing code permits multiple types of medical- and recreational-marijuana-related uses, subject to licensing standards (§5.88 & §5.91).

It defines three types of “medical marijuana business”: “medical marijuana center,” “medical marijuana-infused products manufacturer,” and “optional premises cultivation operation” (§5.88.010). However, it only permits medical marijuana centers to operate in the city.

The licensing standards for medical marijuana centers address zoning district use permissions; discretionary use permits; separation from schools, child care facilities, alcohol or drug treatment facilities, and other medical marijuana businesses; proximity to and compatibility with residential districts, community centers, parks, recreation trails or centers, libraries, hotels, and public buildings open to the general public; total number of licensed centers; advertisements; indoor use; security; hours of operation; on-site consumption; mobile structures; and alcohol sales or consumption (§5.88.070).

It defines four types of “retail marijuana establishment”: “retail marijuana cultivation facility,” “retail marijuana product manufacturing facility,” “retail marijuana store,” and “retail marijuana testing facility” (§5.91.050). However, it only permits retail marijuana stores and testing facilities to operate in the city.

The licensing standards for retail marijuana stores and testing facilities address age of customers; identification verification; packaging; dispensing to customers under the influence of alcohol or controlled substance; product testing; dual operations; zoning district use permissions; total number of licensed stores; discretionary use permits; separation from schools, child care facilities, alcohol or drug treatment facilities; residential and public property; proximity to and compatibility with community centers, parks, recreation trails or centers, libraries, hotels, and public buildings open to the general public; permanent location; and periodic review of suitability of location (§§5.91.090–110).

The city’s zoning code explicitly defines and prohibits “marijuana clubs” (§18.84).
