Small Wireless Facilities and Wireless Facilities in the ROW

This staff report discusses a proposed installation of a DAS within the town. The report notes this scenario would be a better alternative to other wireless facilities (towers), and suggests addressing this through licensing or a franchise agreement rather than through zoning. The report includes the proposal and presentation from the wireless company, as well as a draft license agreement that provides for compensation to the town of a right-of-way access fee of five percent of gross revenues from the DAS network, as well as an in-kind contribution to the town of installed fiber (Article 7). The system was ultimately approved through a franchise agreement, making Flower Mound the first municipality in North Texas to use DAS.
