Environmentally Sensitive Area

This article explains shortcoming of traditional approaches to environmental protection and proposes that overlay zones are an adequate approach to protecting sensitive areas. It compares Euclidean zoning, the National Environmental Policy Act, outright purchasing and condemnation, donation and dedication, nuisance law, and protective covenants. Additionally, it discusses the use of performance standards, both primitive and precise, in conjunction with overlay districts.
