Environmentally Sensitive Areas

This model ordinance provides a template to help communities in New York establish overlay districts that protect critical environmental areas. It discusses wetlands; waterbodies, water bodies, and watercourses; floodplains; aquifers; scenic resources; steep slopes; woodlands; forests and trees; and wildlife and habitat. It includes the following provision sections: findings of fact and intent, overlay designation criteria, performance standards, approval requirements, penalties for offenses, enforcement, appeals, inspections, and critical environmental area management.
