Affordable Housing Programs | Housing Supply Planning
The consolidated city-county’s codified ordinances include several affordable housing policies. Chapter 2.213 outlines the incentive grants program for affordable and workforce housing, administered by the Office of Economic Opportunity and Empowerment. Chapter 17.40 describes the city-county’s inclusionary housing program, which is mandatory for residential developments receiving entitlements or public resources. Affordable housing projects are also eligible for a density bonus, as discussed in §17.12.070.
Environmentally Sensitive Areas
The metro government’s zoning code protects environmentally sensitive areas through performance standards on new construction projects. It includes standards for developments located on hillsides, floodplains, problem soil, and Cedar Glade plant communities (§17.28.010).
Food Systems | Food Trucks
The metro government’s code on streets, sidewalks, and public places provides regulatory parameters for mobile vendor operations on private property and in the public way (§13.08.040). The zoning code addresses minimum parking standards (§17.20.030), and designates commercial use limited to the mobile vending unit (§17.06.70).
Short-Term Residential Rentals
The metro government’s zoning code addresses short-term residential rentals. The code defines two types of short-term residential rentals—owner-occupied and not owner-occupied (§17.04.060). Owner-occupied units are permitted as accessory uses in all but a few zoning districts throughout the metro area; not owner-occupied units are permitted with conditions in multifamily residential districts, all mixed use districts, most office districts, and all commercial, downtown, and shopping center districts (§17.08.030).
The code provides brief development standards for not owner-occupied units that address permit requirements, advertising, and property improvements (§17.16.070.U). It provides detailed standards for accessory owner-occupied units that address qualification requirements, advertising, signage, nuisance, safety, parking, maximum occupancy, contact information, and other issues, as well as detailed information on permit applications, expirations, renewals, and denials or revocations (§17.16.250.E).
The revenue and finance section of the code establishes that transient occupancy privilege tax revenue generated by short-term residential rentals is dedicated to an affordable housing fund (§5.12.060).
