Model Right to Farm Bylaw/Ordinance

The Massachusetts Smart Growth/Smart Energy Toolkit offers a module on Preserving Agricultural Land and Farming Opportunities that includes links to several case studies and a model right-to-farm bylaw intended to help protect the viability of farming by reiterating the importance of—and support for–farming within towns. A notification provision seeks to prevent conflicts between farm operations and new neighbors, and the model offers a dispute resolution process for such conflicts. This bylaw is best used where an Agricultural Commission has been established to help tailor the bylaw and educate the public about the need for such provisions.
