Wind Energy

This model ordinance provides a template to help cities and counties develop supportive regulations for local-serving wind energy generation. It defines two classes of distributed wind energy system by rated capacity – those with capacities less than or equal to 100 kW and those with capacities greater than 100 kW.

It permits smaller systems by right in all areas “where structures of any sort are allowed,” subject to use-specific standards (§4.1). It allows larger systems in non-residential zones with a discretionary use permit, subject to use-specific standards (§4.2).

It does not set maximum height standards, requires all systems be at least 60 feet tall, and allows all turbines to be “tall enough to facilitate proper function” (§4.3). It permits building-mounted systems.

All distributed wind energy systems must comply with setback, access, sign, sound, turbine, utility notification, antenna, and decommissioning standards (§4.4 et seq.).
