This model ordinance provides a template to help cities in New York develop wind energy regulations. It defines three classes of wind energy conversion system (WECS) based on height and rated capacity. The authors suggest setting higher maximum standards for small systems to encourage WECS development (p.5).
It permits very small WECS by right as accessory uses in all zoning districts, subject to use-specific standards (§4.B.1&2). Small and large WECS are allowed with a discretionary use permit, subject to use-specific standards (§4.C & 4.D). It suggests allowing small WECS in all non-residential districts and large WECS in more remote areas (p.8, comment on §4).
It defines use-specific standards and provides commentary for each section (§8).
