Historic Preservation
The city’s codified ordinances establish a Historical Preservation Commission and a Historical Preservation District (§361-102 to 361-108). It outlines criteria for designation and a development and demolition review processes that requires a certificate of appropriateness for exterior work on properties located in the historic district.
Wind Energy
The city’s zoning code regulates large- and small-scale wind energy conversion systems (§361.30). It contains provisions for freestanding and principal-structure mounted wind energy conversion systems (WECS).
It permits WECS in the Wind Energy Overlay District by right, subject to use-specific standards (§361.30.D.1).It permits small-scale WECS under 50kW in the Rural Agricultural and industrial districts by right, subject to use-specific standards (§361.30.D.2).
It allows WECS with a rated capacity greater than 50kW in the Rural Agricultural and industrial districts with a discretionary use permit, subject to use-specific standards (§361.30.D.2). It allows accessory wind generators in residential and commercial districts with a discretionary use permit, subject to use-specific standards (§361.30.D.3).
It bases setback standards from roads and property lines on turbine height; It provides a fixed minimum distance for setbacks from occupied buildings (§361.30.E.1.a). Use-specific standards for all wind energy facilities include height, site safety and access, sign, lighting, noise, shadow flicker, and decommissioning (§361.30.E.1&3). It provides additional standards for systems with a rated capacity greater than 50kW (§361.30.E.2).
