Wind Energy

The county’s zoning code defines and regulates small-scale Private (§13A-12.12.03.a) and large-scale Commercial (§13A-12.13.03.b) wind energy conversion systems (WECS). It differentiates the two by the primary intended use of the energy generated.

It permits small-scale WECS by right, subject to use-specific standards (§13A-12.12.04). The number of turbines permitted depends on lot size (§13A-12.12.05.a). It bases setback standards on WECS height and applies to property lines, easements, and utilities (§§13A-12.12.05.c – e). It includes height, appearance, lighting, flood plain, construction, and soil erosion standards. It details nuisance management procedures (§13A-12.12.06).

It allows large-scale WECS in the agricultural district with a discretionary use permit, subject to use-specific standards (§13A-12.13.04). It includes variable setback standards based on both absolute distances and distances tied to system height (§§13A-12.13.05.a – e). It includes height, appearance, lighting, flood plain, construction (dust emission and soil erosion management) standards. It details nuisance management procedures (§13A-12.13.06).
